Terms of Service - MAHA Healer

1. Acceptance of Terms

By creating an account or using MAHA Healer ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. The Service is operated by MAHA Healer ("we," "us," or "our").

2. Description of Service

MAHA Healer is a health data tracking and analysis platform for families. The Service allows you to upload medical reports, track test results, log journal entries, and use AI-powered features to analyze health data. The Service is not a medical device, does not provide medical advice, and is not a substitute for professional medical care.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account. You agree to notify us immediately of any unauthorized use of your account.

4. Third-Party AI Services & Your API Keys

The Service integrates with third-party AI providers, including but not limited to Anthropic (Claude) and OpenAI (GPT), to provide document parsing, health data analysis, and conversational AI features ("AI Features").

Bring Your Own API Keys. To use AI Features, you must provide your own API keys from these third-party providers. By entering your API keys into the Service, you acknowledge and agree that:

Direct relationship. Your use of third-party AI services is governed by your own agreement with each provider (e.g., Anthropic's Terms of Service, OpenAI's Terms of Use). You are solely responsible for reviewing, understanding, and complying with those terms.
Data transmission. When you use AI Features, the content of your uploaded documents and health data will be transmitted to the applicable third-party AI provider via their API using your API key. This transmission occurs under your account with that provider, not ours.
HIPAA and regulatory compliance. If you are subject to HIPAA or other health data regulations, it is your sole responsibility to determine whether your use of third-party AI services complies with those regulations. This includes, but is not limited to, obtaining any necessary Business Associate Agreements (BAAs) directly with the AI provider if required. We do not act as a Business Associate with respect to data processed by third-party AI services under your API key.
No liability for third-party processing. We are not responsible for how third-party AI providers process, store, retain, or use data sent to them via your API key. We make no representations or warranties regarding the privacy practices, security measures, or regulatory compliance of any third-party AI provider.
API key security. Your API keys are encrypted at rest within the Service. However, you are responsible for the security of your API keys and any charges incurred through their use. You should rotate your keys regularly and revoke them if you suspect unauthorized access.

Optional features. AI Features are optional. The Service can be used for manual health data tracking without providing any API keys.

5. Health Data & Medical Disclaimer

The Service is designed to help you organize and understand health information. However:

The Service does not provide medical advice, diagnosis, or treatment recommendations.
AI-generated analysis and summaries may contain errors and should always be verified by a qualified healthcare professional.
Never make medical decisions based solely on information from the Service.
Always consult your healthcare provider for medical advice.

6. Your Data

You retain ownership of all health data, documents, and content you upload to the Service ("Your Content"). By using the Service, you grant us a limited license to process Your Content solely for the purpose of providing the Service to you. We will not sell, share, or use Your Content for any purpose other than operating the Service.

You may delete Your Content at any time. Upon account deletion, we will delete your data in accordance with our data retention policy.

7. Privacy & Security

We implement reasonable administrative, technical, and physical safeguards to protect Your Content, including encryption in transit and at rest, multi-factor authentication, access controls, and audit logging. For more details, see our Security & Privacy page.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM YOUR USE OF THIRD-PARTY AI SERVICES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to indemnify and hold harmless MAHA Healer, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your use of third-party AI services via your API keys; (c) your violation of these Terms; or (d) your violation of any applicable laws or regulations, including HIPAA.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service with a new "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

11. Termination

You may close your account at any time. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in San Francisco County, California.
